MINUTES FOR JANUARY 9, 2012

The Cherokee County Commissioners met January 9, 2012. The meeting was called to order with Commissioners Garner, Collins and Hilderbrand present. The Pledge of Allegiance was said by all. County Clerk Crystal Gatewood submitted the minutes for January 3, 2012 and Commissioner Collins made a motion to accept the minutes as written by Clerk Gatewood. His motion was seconded by Commissioner Hilderbrand with Commissioners Garner, Collins and Hilderbrand voting in favor. Commissioners Collins, Hilderbrand and Garner, and Clerk Gatewood signed off on the documentation.
EXECUTIVE SESSIONS
County Appraiser Nancy Herrenbruck requested Executive Session for Personnel/Non-Elected. Commissioner Collins made the motion to go into Executive Session for five minutes for Personnel/Non-Elected with himself and Commissioners Garner and Hilderbrand, and County Appraiser Nancy Herrenbruck; his motion was seconded by Commissioner Garner with Commissioners Collins, Garner, and Hilderbrand voting in favor. They went in at 11:45 AM and returned at 11:55 AM.
Commissioner Hilderbrand requested Executive Session for Personnel/Non-Elected. Commissioner Collins made the motion to go into Executive Session for five minutes for Personnel/Non-Elected with himself and Commissioners Garner and Hilderbrand, and County Counselor Kevin Cure; Commissioner Garner seconded the motion with Commissioners Collins, Garner, and Hildebrand voting in favor. They went in at 12:19 PM and returned at 12:25 PM.
MOTIONS
Commissioner Collins made a motion to approve the Water District #19 project as presented by Samantha Dillon and its members present for the water lines to be set in the designated right aways as marked on the map; his motion was seconded by Commissioner Hilderbrand with Commissioners Collins, Garner, and Hilderbrand voting in favor. A copy of the map will be available in the Cherokee County Clerk’s Office in a few weeks.
Commissioner Hilderbrand made a motion for the Cherokee County Commissioners to appoint a Steering Committee for rural water and sewer in the Southeast corner of the county near I-44; Commissioner Garner seconded the motion with Commissioners Collins, Garner, and Hilderbrand voting in favor. The Steering Committee will be chosen by Commissioners Garner, Hilderbrand, and Collins from citizens all over the county.
Commissioner Collins made a motion to approve and pay the January 2012 Mid-Month Accounts/Payables; his motion was seconded by Commissioner Garner with Commissioners Collins, Garner, and Hilderbrand voting in favor. Those signing off on the documentation were Commissioners Garner, Collins, Hilderbrand, and Cherokee County Clerk Crystal Gatewood.
Commissioner Collins made a motion to elect Commissioner Hilderbrand the Commission Chair for 2012; his motion was seconded by Commissioner Garner with Commissioners Hilderbrand, Collins, and Garner voting in favor.
Commissioner Hilderbrand made a motion to elect Commissioner Garner as Vice Chair of the Commission for 2012; his motion was seconded by Commissioner Collins with Commissioners Hilderbrand, Collins, and Garner voting in favor.
Commissioner Collins made a motion to designate the American Bank of Baxter Springs, Columbus, and Galena as the official working bank for the county; his motion was seconded by Commissioner Garner with Commissioners Hilderbrand, Collins, and Garner voting in favor.
Commissioner Garner made a motion to designate The Columbus News-Report as the official county paper for 2012; his motion was seconded by Commissioner Collins with Commissioners Hilderbrand, Collins, and Garner voting in favor.
Commissioner Garner made a motion to appoint Kevin Cure as the Commissioners Attorney (County Counselor) for 2012; his motion was seconded by Commissioner Collins with Commissioners Hildebrand, Collins, and Garner voting in favor.
Commissioner Garner made a motion to appoint Cecil Brown as Noxious Weed Director for 2012; his motion was seconded by Commissioner Collins with Commissioners Hilderbrand, Collins, and Garner voting in favor.
Commissioner Collins made a motion to appoint Leonard Vanatta as Road & Bridge Supervisor and Gene Langerot as the County Lot Supervisor for Cherokee County for 2012; his motion was seconded by Commissioner Garner with Commissioners Hilderbrand, Collins, and Garner voting in favor.
Commissioner Garner made a motion to appoint Jason Allison as the Emergency Preparedness Director for Cherokee County for 2012; his motion was seconded by Commissioner Collins with Commissioners Hilderbrand, Collins, and Garner voting in favor.
Commissioner Collins made a motion appointing Betha Elliott as the Director of the Cherokee County Health Department for 2012; his motion was seconded by Commissioner Garner with Commissioners Hilderbrand, Collins, and Garner voting in favor.
Commissioner Garner made a motion appointing Mense, Churchill and Mense as the official audit firm for Cherokee County for 2012; his motion was seconded by Commissioner Collins with Commissioners Hilderbrand, Collins, and Garner voting in favor.
Commissioner Hilderbrand made a motion too recess for lunch until 1:30 PM; his motion was seconded by Commissioner Collins with Commissioners Collins, Garner, and Hilderbrand voting in favor.
OTHER BUSINESS
Raymond Griffith came before the commission regarding the land issue with Kansas Parks and Wildlife.
Leonard Vanatta of the Road and Bridge Department came before the commission and let them know that he had a meeting in the Courthouse at 10:00 AM today with the engineers, KDOT, and Beachner Construction to set up construction dates for the Weaver Bridge Project. Commissioner Collins asked Leonard to save the engraved name off of the old bridge so the county can donate it to the Baxter Springs Museum. Commissioner Hilderbrand asked Leonard to have a county crew clean up the area around the Route 66 Bridge for the upcoming ceremony with the state officials coming.
Jim Dahmen, Ray Barnby, and Joe Caputo presented phase 1 of the project to build a Physician’s Office in the city of Galena. They brought an artist’s rendition to show the commission. They also discussed the IRB requirements for the funding of the project with the commission. Mayor Dale Oglesby also spoke at the meeting and explained how the city of Galena was helping with the current and future growth of the medical facility and how the city, school district, and county has benefitted financially from the Ortho Facility located in Galena. Oglesby also said no county or city money has been spent for the Orthopedic Specialists of the Four States, LLC. The group came before the commission to present the project as an FYI only. The commission thanked them for coming in. Attached to these minutes is a copy of their presentation.
Jason Allison came before the commission and submitted the details for purchasing ten storm sirens for the county. Commissioner Garner wants bid specs sent to area banks for the county portion of the payment for the lease-purchase agreement. Jason Allison and County Clerk Gatewood will be responsible for the paperwork to be sent out to the area banks for their bids. Attached to the minutes is a copy of the information Allison presented to the commission.
RESOLUTIONS
Commissioner Garner made the motion to approve and pass Resolution #01-2012 in regards to ……A RESOLUTION PROVIDING FOR COLLECTION OF REGISTRATION FEES AS PROVIDED FOR UNDER THE PROVISIONS OF HB2312 (2011) AMENDING THE PROVISIONS OF K.S.A. 50-1, 109 et seq.
WHERAS, HB 2312 amending the provisions of K.S.A. 50-01, 109 et seq. required every business in Cherokee County and not otherwise in an incorporated city, that purchase any regulated scrap metal, to first register each place of business with the Cherokee County Commission and the business shall file with the Cherokee County Clerk…
NOW THERFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF CHEROKEE COUNTY, KANSAS meeting in regular session approved a registration fee of $300.00 for a ten year license and an annual re-newel fee after of $50.00.
Commissioner Garner’s motion was seconded by Commissioner Collins with Commissioners Hilderbrand, Collins, and Garner voting in favor. Commissioners Hilderbrand, Collins, Garner, and County Clerk Crystal Gatewood signed off on the documentation. A copy of this resolution is attached to these minutes.
ADJOURNMENT
Commissioner Collins made a motion to adjourn at 1:47 PM; his motion was seconded by Commissioner Garner with Commissioners Collins, Hilderbrand, and Garner voting in favor. The next Cherokee County Commission meeting will be held January 23, 2012 at 9:00 AM in the Cherokee County Courthouse in Columbus, Kansas. The Cherokee County Commission will not meet January 16, 2012 in observance of Martin Luther King Jr. Day, and the Cherokee County Courthouse will also be closed.
